1. Acceptance of Terms
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. In that case, you includes the organization where appropriate.
Our Privacy Policy explains how we handle personal data and is part of the information provided with these Terms.
2. Description of Chessiax
Chessiax is an independent personalized chess-training and analysis service currently offered in early beta. Depending on the features currently available, it may help users:
- analyze public games and profiles from third-party chess platforms;
- submit PGNs for chess-engine and rules-based review;
- generate Coach Reports, training plans and personalized recommendations;
- practice openings, tactics and endgames;
- save notes, progress, feedback and training history locally or to a Chessiax account; and
- review usage and account-linked training data.
Features, limits and results may differ between guests and signed-in users and may change during the beta.
The current beta does not implement payment processing or third-party advertising.
3. Eligibility and accounts
You must be legally capable of agreeing to these Terms, or use Chessiax with the permission of a parent or legal guardian where required by applicable law.
When creating an account, you must provide accurate information, keep your login credentials confidential and promptly tell us if you suspect unauthorized use. You are responsible for activity carried out through your account unless applicable law provides otherwise.
Chessiax currently supports its own email/password account flow through a third-party authentication provider. A Chessiax account is separate from an account on Chess.com or any other chess platform.
4. Third-party chess platforms and public data
The Service can use public information made available by independent chess platforms, including a public username, public profile information, ratings, game records and PGNs. You may submit a PGN or request analysis of a public username, including a profile other than your own.
You may use public-profile analysis only subject to applicable law, the source platform's terms, these Terms and the rights of other people. Do not use Chessiax to bypass access controls, obtain private data, misrepresent your identity, falsely claim ownership of an account, or harass or profile another person unlawfully.
Chessiax does not claim ownership of public game data, PGNs or other third-party chess data merely because the Service retrieves or analyzes it.
5. Chess.com independence and non-affiliation
Chessiax is an independent service. It is not endorsed by, sponsored by, operated by or affiliated with Chess.com unless Chessiax and Chess.com explicitly state otherwise.
Chess.com names, marks, platform content and other rights belong to Chess.com or their respective owners. References and links identify an independent platform or data source and do not transfer any rights to Chessiax.
The current Service uses the supported Chess.com Public API. These Terms do not claim that Chess.com OAuth is active, that Chessiax verifies ownership of a Chess.com account, or that Chessiax can access private Chess.com data.
6. User responsibilities
You are responsible for:
- the information, PGNs, notes and feedback you submit;
- having any permissions needed to submit or use that material;
- checking analysis and recommendations before relying on them;
- securing your account and device; and
- complying with applicable laws, competition rules and third-party platform terms.
Do not submit sensitive personal information in free-text notes, PGNs or feedback unless it is genuinely necessary and lawful to do so.
7. Acceptable use
You must not, and must not help others to:
- use the Service unlawfully, fraudulently or to infringe another person's rights;
- access or attempt to access accounts, systems or data without authorization;
- probe, scan, overload, disrupt or circumvent security, rate limits or access controls;
- introduce malware or harmful code;
- scrape, automate or send requests in a way that unreasonably burdens the Service or a third-party platform;
- extract or reuse content in violation of law, these Terms or third-party rights;
- impersonate another person or falsely imply endorsement, account ownership or affiliation;
- use Service output to cheat where assistance is prohibited, including during a live game or competition; or
- reverse engineer or circumvent technical restrictions except to the limited extent that applicable law expressly permits despite this restriction.
We may take proportionate steps to investigate suspected abuse and protect users, the Service and third parties.
8. Chess analysis and training disclaimer
Chessiax provides automated, engine-assisted, statistical and rules-based training information. Analysis may be incomplete, inaccurate, unavailable, based on limited public games, or affected by data quality, engine availability and software errors.
Coach Reports, evaluations, classifications, opening suggestions and training plans are recommendations, not guarantees. Chessiax does not promise rating improvement, tournament results, a particular learning outcome, or perfect engine, coach or data accuracy. You remain responsible for your chess and training decisions.
9. Beta service and availability
The Service is an early beta and may contain defects. We may test, add, modify, limit, suspend or remove features. Data formats and compatibility may change. The Service may be interrupted by maintenance, provider outages, third-party API changes, abuse prevention or circumstances outside our control.
We do not promise uninterrupted, secure or error-free availability. We will use reasonable care in operating the Service, subject to the beta nature of the product and mandatory law.
10. Intellectual property
As between you and Chessiax, the Chessiax code and software, original user interface and design, branding, original analysis and training architecture, and original content are owned by the Chessiax operator or applicable licensors. They are protected by intellectual-property and other laws.
These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service for its intended purpose while you comply with these Terms. They do not transfer ownership of Chessiax, its code, software, design, branding, original analysis and training architecture, or original content to you or to any third-party platform.
Chess.com trademarks, platform content, public game data and other third-party rights remain with their respective owners. Open-source software and licensed datasets remain subject to their applicable licenses. Chessiax does not claim ownership of third-party chess data.
You may not copy, sell, license, distribute or create derivative commercial services from protected Chessiax materials except with permission or where applicable law or an applicable open-source license allows it.
11. User-provided content and data
You retain whatever ownership rights you have in PGNs, notes, feedback and other material you submit (User Content). You do not transfer ownership of User Content to Chessiax.
You grant Chessiax a limited, non-exclusive license to host, copy, process, transmit, format and display User Content only as reasonably necessary to provide, maintain, secure and improve the Service, comply with law and exercise our rights under these Terms. This license lasts only as long as reasonably necessary for those purposes, subject to backups, legal obligations and the retention described in the Privacy Policy.
You represent that you have the rights and permissions necessary for Chessiax to process User Content as described. Public or third-party data remains subject to the rights and terms that already apply to it.
12. Feedback
If you send suggestions or product feedback, you allow us to use it to evaluate, operate, secure and improve Chessiax without payment to you. This does not transfer ownership of unrelated material or intellectual property you already own. Do not send confidential information through feedback forms.
13. Third-party services, software and links
The Service relies on or links to independent services, software and data sources. Chessiax currently uses services, software or resources associated with Supabase, Render, Google Analytics, Chess.com, OpenAI, Stockfish and browser-delivered code or assets from content-delivery providers.
Third parties have their own terms, privacy practices and availability. Chessiax is not responsible for a third-party service or link merely because the Service connects to, retrieves public data from, or refers to it. Nothing in these Terms limits responsibility that cannot lawfully be excluded.
14. Account suspension and termination
You may stop using the Service at any time. Available account tools may let you clear selected local or synchronized training data, but they do not currently delete the login account or every category of data. See the Privacy Policy or contact privacy@chessiax.com for a complete privacy request.
We may suspend or terminate access where reasonably necessary to address a material or repeated breach of these Terms, security risk, unlawful conduct, harm to users or third parties, or a legal requirement. Where appropriate, we will consider the nature of the issue and use a proportionate response.
Sections that by their nature should survive termination—including intellectual property, disclaimers, liability, disputes and rights relating to previously processed data—will continue to apply.
15. Changes to the Service
We may change the Service during the beta, including its features, limits, data sources and technical providers. If a change materially affects how personal data is handled, we will update the Privacy Policy and provide notice where required.
We do not promise to maintain a particular feature, integration, data format or level of availability.
16. Disclaimers
To the extent permitted by law, the Service is provided on an as available basis. We do not make warranties beyond those expressly stated in these Terms or required by law, including warranties that:
- every public profile or game will be available, complete or current;
- every engine evaluation, Coach Report or recommendation will be accurate;
- the Service will meet a particular training objective; or
- third-party services will remain available or unchanged.
Nothing in these Terms excludes statutory warranties, remedies or duties that cannot be excluded.
17. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so is prohibited, including liability for fraud or fraudulent misrepresentation, intentional misconduct, or personal injury caused by negligence where such liability cannot be limited.
Subject to that rule and to mandatory consumer law, Chessiax is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, loss arising from third-party platform unavailability, or loss of data that was reasonably avoidable through available backup or export measures.
For consumers, Chessiax remains responsible for losses that are a foreseeable result of our breach of these Terms or failure to use legally required care. Your local law may provide additional rights and remedies.
18. Indemnity where legally appropriate
If you use the Service for business purposes, you will indemnify Chessiax against reasonable third-party claims, losses and costs arising directly from your unlawful use, your material breach of these Terms, or User Content you had no right to submit, to the extent permitted by law.
This section does not apply to a consumer where it would be unfair or contrary to mandatory consumer law, and it does not require anyone to indemnify Chessiax for Chessiax's own unlawful conduct, negligence or breach.
19. Governing law and disputes
These Terms are governed by Swedish law, without regard to conflict-of-law rules.
If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your country of residence. You may also have the right to bring a dispute in the competent courts of your country of residence. Otherwise, disputes will be submitted to the competent courts of Sweden.
Before starting formal proceedings, you and Chessiax are encouraged to contact each other and attempt to resolve the issue in good faith.
20. Mandatory consumer rights preserved
Nothing in these Terms limits or waives rights that cannot lawfully be limited or waived, including mandatory rights under applicable Swedish and EEA consumer law. If a provision conflicts with mandatory law, that law applies to the extent of the conflict, and the remaining provisions continue in effect.
21. Changes to these Terms
We may update these Terms to reflect changes in the Service, law, security, providers or business model. We will post the updated Terms with a new last-updated date. If a change is material, we will provide additional notice where reasonably possible and legally required.
Changes apply prospectively from their stated effective date. If you do not agree to updated Terms, you should stop using the Service before they take effect.
22. General terms
If a provision is unenforceable, it will be adjusted only as much as necessary or severed, and the remaining Terms will continue. A delay in enforcing a provision is not a waiver. You may not transfer your rights under these Terms without our consent, but mandatory consumer rights are unaffected.
These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, form the agreement governing the Service.
